Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Setalink website and services (the "Service") provided by Setalink ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service in any way, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Setalink is a link-in-bio platform designed for fitness coaches and personal trainers. The Service allows users to create a public profile page that aggregates links, digital products, booking slots, and email capture forms. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. Account Registration

You must register for an account to access most features. You agree to provide accurate and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@setalink.com if you suspect unauthorized access to your account.

You may not create an account on behalf of another person without their permission, use a username that is offensive, infringing, or misleading, or create multiple accounts to circumvent restrictions.

4. Subscription Plans and Billing

Setalink offers a free plan and paid subscription plans (Pro and Creator). Paid subscriptions are billed in advance on a monthly or annual basis. All fees are in USD and non-refundable except as described in our 30-day money-back guarantee.

30-Day Money-Back Guarantee: If you are not satisfied with a paid plan, you may request a full refund within 30 days of your initial payment by contacting hello@setalink.com. This guarantee applies to first-time purchases only.

We may change subscription pricing with 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

5. Digital Products and Creator Payouts

Creator plan subscribers may sell digital products, courses, and coaching packages through the Service. When a sale is made:

  • Platform Fee: Setalink charges a 6% platform fee on the gross sale amount. This fee covers payment infrastructure, secure file delivery, and platform maintenance.
  • Stripe Processing: Standard Stripe payment processing fees also apply (typically 2.9% + $0.30 per transaction).
  • Payouts: Earnings are deposited directly into your Stripe Connect account per Stripe's standard payout schedule.

You are solely responsible for determining and remitting any applicable taxes on your sales. Setalink does not provide tax advice.

By listing a product, you represent that you have all necessary rights to sell it and that it does not infringe any third-party intellectual property rights.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Post or distribute illegal, harmful, fraudulent, or misleading content
  • Infringe any third party's intellectual property, privacy, or other rights
  • Distribute malware, spam, or phishing content
  • Sell prohibited items including controlled substances, weapons, or adult content
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use automated means to scrape, crawl, or extract data from the Service
  • Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate accounts that violate this policy without refund.

7. Intellectual Property

The Service and its original content (excluding user-generated content) are the exclusive property of Setalink and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

You retain ownership of all content you upload or create on the Service. By posting content, you grant Setalink a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving the Service.

8. Termination

You may delete your account at any time from your dashboard settings. We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.

Upon termination, your right to use the Service ceases. Your public profile will be taken offline. We will retain your data for 30 days before deletion, during which time you may contact us to export your data.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SETALINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
